§ 2.0 — Privacy Policy & Data Processing (GDPR)

§ 2.1 — In accordance with Regulation (EU) 2016/679 (General Data Protection Regulation), personal contact data submitted via our consultation consoles is processed exclusively for client communication, project delivery, and statutory tax reporting.
§ 2.2 — We never sell, rent, or distribute personal information to unauthorized third-party brokers. Data is securely retained within encrypted EU-hosted cloud systems in compliance with ISO/IEC 27001 standards.
§ 2.3 — Data subjects retain the right to access, rectify, erase, restrict processing, and port personal data under Articles 15–20 of the GDPR. Requests should be directed to [email protected].
§ 2.4 — Personal data is retained for the duration necessary to fulfill contractual obligations and comply with statutory retention requirements (typically 5 years for financial records under Polish tax law).

§ 3.0 — Terms of Service
§ 3.1 — All digital services, software deliverables, and engineering advisory packages provided by ModernDigitalCore are governed by explicitly contracted Statements of Work (SOW) executed between the Client and ModernDigitalCore.
§ 3.2 — Upon complete settlement of agreed commercial invoices, ModernDigitalCore assigns all worldwide intellectual property rights in the client-specific software deliverables, design tokens, and digital assets directly to the Client.
§ 3.3 — Project timelines are estimates based on standard scope parameters. Delays caused by third-party integrations, client feedback cycles, or force majeure events may extend delivery schedules with written mutual agreement.
§ 3.4 — Scope modifications requested after project kickoff may incur additional commercial adjustments. All change orders require written authorization before implementation.
§ 3.5 — Each engagement includes a post-delivery support window as specified in the individual SOW. Extended support and maintenance retainers are available as separate commercial agreements.
§ 5.0 — Refund & Reimbursement Policy
§ 5.1 — Deposits and advance payments are non-refundable once project work has commenced. The commencement date is defined as the first billable activity following SOW execution.
§ 5.2 — If a project is cancelled by the Client before work commencement, a full refund of any advance payment will be processed within 14 business days, minus any administrative processing fees.
§ 5.3 — For milestone-based engagements, completed and approved milestones are non-refundable. In-progress milestone work may be eligible for partial reimbursement at the sole discretion of ModernDigitalCore.
§ 5.4 — Refund requests must be submitted in writing to [email protected] within 30 days of the relevant invoice date. Approved refunds will be processed to the original payment method within 14 business days.
§ 5.5 — No refunds are available for completed and delivered work that meets the specifications outlined in the approved SOW. Disputes regarding deliverable quality are subject to the review process defined in § 3.4.
§ 6.0 — SLA & Uptime Commitments
§ 6.1 — Clients enrolled in active maintenance retainers benefit from our 99.98% uptime availability guarantee and priority 2-hour technical support dispatch window.
§ 6.2 — SLA monitoring is conducted via automated 60-second interval health checks across all client infrastructure nodes. Breach notifications are dispatched within 15 minutes of detection.
§ 6.3 — Scheduled maintenance windows are communicated at least 72 hours in advance and are excluded from uptime calculations. Emergency maintenance may be initiated without prior notice to protect client infrastructure.
